The following terms and conditions are designed to protect Sher Vancouver and its representatives and the interviewee from any harm by participating in the Sher Vancouver Out and Proud Project.

Agreement
By agreeing to participate via making a submission for the Sher Vancouver Out and Proud Project via email, Facebook message, or other methods of communication you accept the terms and conditions below:

Guarantee Limitation
I recognize that during the process of coming out and sharing you’re coming out story with the public and/or the internet, discomfort may arise. This storytelling does not guarantee resolution of any kind or assure success with coming to terms with your sexual or gender identity, either explicit or implied. This means that there is no guarantee as to the outcome from the purpose, support, or service that this website is trying to offer.

Suicidal Ideation
I declare that as a participant in the Sher Vancouver Out and Proud Project, I am free of suicidal thoughts and suicidal ideation. If I am suicidal I will seek the help of my family doctor or go to the nearest hospital emergency room via ambulance if necessary.

Legal Liability
I declare that as a participant in the Sher Vancouver Out and Proud Project, I permanently agree to release and indemnify Sher Vancouver LGBTQ Friends Society and its founder, Amar Singh Sangha (also known as Alex Sangha) from all suits, claims, and other actions originating from the Sher Vancouver Out and Proud Project website (https://shervancouver.wordpress.com), as well as any distribution of the interviewee’s profile on the project website and social media networks such as but not limited to Facebook, Twitter, and Linkedin. Your profile may also be picked up by the mainstream media and other outlets on the internet around the world.

Safety Precautions

HARM – I agree to give Sher Vancouver and its representative’s permission to contact the various authorities if I am at risk of harm to myself or others.

PHOTO – Participants are asked to provide a JPEG image of them with a photo credit if necessary. Participants have the option of not providing a photo, and instead, the Sher Vancouver logo will be used as an image on their profile.

NAME – Participants are asked to provide their legal name. Participants have the option of providing a pseudonym, pen name, first name, initials, or no name to protect their identity especially if they live in a country where homosexuality is illegal and their health and safety may be at risk if they publically came out.

QUESTIONS – Participants are asked to respond to the five questions in their own words. Minimal edits will be done if needed for clarity and legal purposes. This implies that interviewees are to take responsibility for their interviews and any resulting response or reaction.

WEBSITE LINKS – Participants have the option of providing personal and professional website links to showcase their work if applicable at their own risk.
​

BYLINE – Participants are asked to provide a byline describing how they would like to be identified, their vocation(s), and location (i.e. city, country). Providing location information is also optional.

REMOVAL – Participants can ask for their profile to be removed at any time by sending a written request via email to info@shervancouver.com

Consent

I declare that as a participant in the Sher Vancouver Out and Proud Project, I have read and understood all the information detailed above in this terms and conditions and consent to be profiled on this project website.
These terms and conditions are subject to change at any time.

SUBMISSION RELEASE
(The OUT and PROUD Project)

For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the undersigned (“Licensor”) hereby grants to SHER VANCOUVER LGBTQ FRIENDS SOCIETY (“Producer”) the right to use the literary works, photographs, information, material and records that may contain elements of my life story, including any and all personal information, stories, narratives, characters (collectively, the “Works”) submitted by me in connection with the online visual, and audio-visual project currently entitled “The OUT and PROUD Project (the “Project”), including the production, distribution, exhibition, broadcast, advertising, publicizing and exploitation thereof, including in any webisodes, clips or ancillary or promotional productions relating to the Project, by all means, media, devices, processes and technology now or hereafter known or devised in perpetuity throughout the universe.

Licensor agrees that the Project and all rights therein shall be the sole property of Producer, and that Producer shall have the rights throughout the universe: (i) to use, re-use or not use any or all of the Works (including all rights therein) in the Project and in the advertising and promotion thereof; and (ii) to reproduce, sell, exhibit, transmit, telecast, broadcast, distribute and otherwise commercially exploit all or any part of the Project in any and all manner, media, formats and markets and by any means now known or hereafter devised, and to license others to do any of the foregoing.

Licensor hereby releases and discharges Producer, its employees, agents, licensees, successors and assigns from any and all claims, demands or causes of action that it may have for libel, defamation, invasion of privacy or right of publicity, infringement of copyright or trademark, or violation of any other right arising out of or relating to any utilization of any of the rights granted under this Agreement.

Licensor warrants and represents that Licensor is the owner or authorized licensee or assignee of all right, title and interest (including copyright) in and to the Works, and that the consent of no other third party (including without limitation any parties who may have contributed to the Works, who may be depicted in the Works, or who may be referenced in the Works) is required to enable Producer to use the Works and that such use will not violate or infringe upon the copyright, artistic, trademark and/or other rights of any third parties and that Licensor will indemnify and hold Producer, its licensees and assigns, harmless from and against any and all claims, damages, liabilities, costs and expenses arising out of a breach of the foregoing warranty.

Licensor agrees that Producer shall have the unlimited right to vary, alter, modify, add to and/or delete from the Works, and to rearrange and/or transpose the depiction contained therein, and to use a portion or portions of the depiction or character together with any other artistic, literary, dramatic or other material of any kind. Licensor hereby expressly waives any and all moral rights in and to the results and proceeds of the Works as used in connection with the Project which Licensor may have whether now or in the future, at law or in equity.

All rights, licenses and privileges herein granted to Producer are irrevocable and not subject to rescission, restraint or injunction under any circumstances. In the event of any breach or alleged breach of this Agreement, Licensor will be limited to its remedy at law for damages (if any) and will not be entitled to rescind or terminate this Agreement or to any injunctive relief which may prevent or impair the production, distribution or other exploitation of the Project. Nothing herein shall be construed to obligate Producer to use the Works in the Project or to produce or distribute the Project or any of the rights granted herein. Producer shall have the right to assign any of its rights under this Agreement to any third party.

This Agreement shall be construed according to the laws of the Province of British Columbia applicable to agreements that are executed and fully performed within said Province. This Agreement contains the entire understanding of the parties relating to the subject matter, and this Agreement cannot be changed except by written agreement executed by the party to be bound.
